Please read these Terms and Conditions carefully, as they outline our and your legal rights and responsibilities for our email marketing services. 

These Terms and Conditions form a legally enforceable agreement between you, either as an individual or on behalf of a company ("THE CLIENT"), and HR MONK, as well as THE OFFER and THE SERVICE :"Email Marketing Campaign" "Sponsorship Campaign" or "Lead Generation" 

 

A.CONTENT 

  • THE CLIENT must provide the content  [HTML or Word copy] for its email marketing campaigns 

  • The content must be supplied to HR MONK at least 7 days to 48 hours before to the date of THE CAMPAIGN; beyond 48 hours, HR MONK has the option to cancel THE CAMPAIGN with no refund.

  • HR MONK may not offer THE CLIENT design assistance. 

  • No modification or adjustment shall be made by HR MONK. 

  • HR MONK is not responsible for any errors or omissions made by THE CLIENT in the placement of any advertisement. 

 

B. PRICING AND PAYMENT FOR THE SERVICE 

  • THE CLIENT WILL PAY THE EXACT AMOUNT ON RECEIPT OF ITS INVOICE.

  • ALL PAYMENTS MUST BE MADE BEFORE THE DATE OF THE CLIENT'S FIRST CAMPAIGN OR THE START OF A SERVICE.

  • NO CAMPAIGNS OR SERVICES WILL BE PROVIDED UNLESS FULL PAYMENT IS RECEIVED.

C. OBLIGATIONS FOR HR MONK 

  • HR MONK should provide THE SERVICE in line with the terms of THE CONTRACT and THE OFFER, which THE CLIENT has accepted, in a competent and professional manner. 

  • THE SERVICE: HR MONK will disseminate your HTML or Word document to its HR Email list. 

  • HR MONK offers no warranties, guarantees, or promises and is thus not liable for the performance of the emailing campaign. However, HR MONK may provide a free replacement if one or more campaigns are not satisfactory at the CLIENT's request. 

 

D. DATA PROCESSING 

  • HR MONK warrants and represents that it will adhere to all applicable data privacy legislation, including the GDPR (General Data Protection Regulation) and PECR (Privacy and Electronic Communications Regulations). 

  • THE CLIENT acknowledge that HR MONK email marketing databases [HR & SPONSORSHIP] includes recipients fully opt-in,  as well as recipients that have been processed as valid under "LEGITIMATE INTEREST" as stated in the PECR act.

  • If the Buyer receives email data from HR MONK as a result of a lead generation project or a SERVICE, then Buyer's genuine interest is the legal basis for processing the data.

E. CANCELLATION / RESCHEDULING OF A CONFIRMED CAMPAIGN

  • In case of cancellation or rescheduling of a confirmed campaign, THE CLIENT has up to 10 days before THE CAMPAIGN's date to contact HR MONK to confirm a new date for THE CAMPAIGN

  • Past 10 days THE CAMPAIGN will not be rescheduled and be considered annulled with no reimbursement nor credit note

  • HR MONK shall not be liable for any loss suffered or incurred by the Buyer as a result of HR MONK's inability to perform the Contract due to any act of God, war, lockout, strike, fire, explosion, flood, fog, bad weather, power failure, pandemic, failure of telecommunication lines, delay in transit, postal delay, theft, malicious damage, riot, or any other unexpected or exceptional cause or circumstance beyond HR MONK's reasonable control.
